Internal Investigations – Keeping It Legal
Every human resources professional, at some point in their career, will be called upon to conduct an internal investigation. An effective investigation can minimize future legal exposure and reduce costly claims against the company. In this session, attendees will learn how to conduct a thorough, impartial and prompt internal investigation. Through the use of a real-world complaint, attendees will have an opportunity to complete an accelerated mock investigation complete with all the twists and turns of an actual investigation. By the end of the presentation, the attendees will know how to:
establish an affirmative defense
create an investigation plan
avoid adverse employment actions
gather independent facts
make recommendations
prepare an investigation summary.
This program adds to the PHR/SPHR Body of Knowledge in the following areas:
48 Applicable federal, state and local laws affecting employment in union and nonunion environments, such as anti discrimination laws, sexual harassment, labor relations, and privacy
52 Workplace behavior issues/practices
65 Internal investigations, monitoring, and surveillance techniques
71 Communication skills and strategies
72 Organizational documentation requirements to meet federal and state requirements
